(UKITED KINGDOM v. IRAN)

ORDER

The President of the International Court of Justice,

having regard to Article8 of the Statute of the Court,
having regard to Article 62 of the Rules of Court,

having regard to the Application dated May26th, 1951,whereby
the United Kingdom of Great Britain and Northern Ireland insti-
tuted proceedings against the Empire of Iran concerning the Anglo-
Iranian Oil Company,

having regard t.o Orders made on July 5th, August aand and
December zoth, 1'951,fixing and extending the time-limits for the
deposit of the Mennorial and the Counter-Memorial in this case and
reserving the rest of the proceedings

Whereas, withi:n the time-limit fixed for the deposit of the
Counter-Memorial, the Imperial Government of Iran has filed a
document entitled "Preliminary Observations: refusal by the
Imperia1 Governmentto recognizethe jurisdiction of the Co;rt"

Whereas, accord.ingly, under Article 62, paragraph 3, of the Rules
of Court, the proceedings on the merits are suspended, and the said
4Article fixes the procedure to be followed in dealing with the
Preliminary Objection so raised ;

Whereas, notwithstanding that the Agent of the United Kingdom
Government appeatrs to have indicated in advance in his Memorial
that, in the circunlstances which have just occurred, he would be
satisfied to reply orally to an objection to jurisdiction, this indica-
tion does not seem sufficient to authorize the President of the Court
to depart from the procedure laid down in Article 62, paragraph 3,
of the Rules ;

Fixes March 27th, 1952, as the time-limit within which the
Government of the United Kingdom of Great Britain and Northern
Ireland may preserjitthe written statement of their observations and
submissions in regard to the Preliminary Objection lodged by the
Imperial Governm~rnt of Iran.

Done in French and English, the French text being authoritative,
at the Peace Palace, The Hague, this eleventh day of February, one
thousand nine hundred and fifty-two, in three copies, of which one
will be placed in the archives of the Court and the others will be
transmitted to the Government of the United Kingdom of Great
Britain and Northern Ireland and to the Imperial Government of
Iran, respectively.

Le Président de la Cour internationale de Justice,
vu l'article8du Statut de la Cour,

vu l'article 62 du Règlement de la Cour,

vu la requêtedatéedu 26 mai1951 ,ar laquelle le Gouvernement
du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord a
introduit devantla Cour contrel'Empire de l'Iran une instance
relativeà l'Anglo-Iranian Oil Company,
vu les ordonnances du5 juillet, d22 août et du20 décembre
1951 fixant puis prorogeales délaispour le dépôt du mémoireet
du contre-mémoire en ladite affaire et réservant la suite de la pro-
cédure ;

Considérant que, dans le délai fixé pour le dépôt du contre-
mémoire, le Gouvernement impérial de l'Iran a présenté unepièce
intitulée Observationspréliminair:refus du Gouvernementimpé-
rial deeconnaitrela compétence dela Co»;

Considérant que, de ce fait, aux termes de l'article 62, para-
graphe 3, du Règlement, la procédure sur le fond est suspendue et

Considérant que, bien que dans son mémoire l'agent du Gouver-
nement du Royaume-Uni ait paru indiquer par avance que, dans
l'éventualité qui vient de se présenter, il lui suffirait de répondre
oralement à une contestation de compétence, cette indication ne
paraît pas suffisante pour autoriser le Président de la Cour à se
départir de la procédure prescrite par l'article2, paragraphe 3,du
Règlement ;

Fixe au 27 mars 1952 la date d'expiration du délai dans lequel le
Gouvernement du Royaume-Uni de Grande-Bretagne et d'Irlande
du Nord pourra déposerun exposé écritcontenant ses observations
et conclusions sur l'exception préliminaire soulevéepar le Gouver-
nement impérial de l'Iran.

Fait en français et en anglais, le texte français faisant foi, au

Palais de la Paix, àLa Haye, le onzefévrier milneuf cent cinquante-
deux, en trois exemplaires, dont l'un restera déposéaux archives de
la Cour et dont les autres seront transmis respectivement au Gouver-
nement du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord
et au Gouvernement impérial de l'Iran.
