The International Court of Justice,
After deliberation,
Having regard to Articles 40 and 48 of the Statute of tlie Court,
Makes thefollowin Order:
Whereas by an Application dated May zand, 1947, under
Article 40, paragraph 1, of the Statute, and Article 32, paragraph 2,
of the Rules of Court, the Government of the United Kingdom of
Great Britain and Northern Ireland instituted proceedings before
the Court against the Government of the People's Republic of
Albania. These proceedings concerned the incident which occurred
in the Corfu Channel on October zznd, 1946, when two British
destroyers struck mines, the explosion of which caused darnage
to the vessels and heavy loss of ;ife
Whereas the United Kingdom Government on October xst, 1947,
filed a Memorial with statements and subinissions ;
Whereas, within the time-limit fixed for the presentation of the
Counter-Menlorial, the Agent for the Albanian Government, by
a document dated December ~st, 1947, and filed in the Registry
on December gth, 1947, submitted a Preliminary Objection to tlic
Application on the grou~id of inadmissibil;ty
Whereas by a Judgment dated March z5th, 1948, tlie Coiii-t
rejected the Preliminary Objection, decided that proceedin011
the merits should continue and fixed the time-lirnits for the filirig
of subsequent pleadings as follows : THE CORFU CHANNEL CASE 54
(a)for the Counter-Memorial of the Albanian Government,
Tuesday, June 15th, 1948 ;
(b) for the Reply of the United Kingdom Government, Monday,
August znd, 1948 ;
(c) for the Rejoinder of the Albanian Government, Monday,
September zoth, 1948 ;
Whereas after delivery of the Judgment the Court was notified
by the Agent of the Albanian Government and by the Agent of
the Government of the United Kingdom of the conclusion on
March 25th, 1948, of a Special Agreement ;
Whereas the Special Agreement in question is as follows :
"The Government of the People's Republic of Albania,
represented by their Agent Mr. Kahreman Ylli, Envoy Extra-
ordinary and Minister Plenipotentiary of Albania at Paris ;
and
the Government of the United Kingdom of Great Britain and
Northem Ireland, represented by their Agent Mr. W. E. Beckett,
C.M.G., K.C., Legal Adviser to the Foreign Office ;
Have accepted the present Special Agreement, which has been
drawn up as a result of the Resolution of the Security Council
of the 9th April, 1947, for the purpose of submitting to the Inter-
national Court of Justice for decision the following questions :-
(1) 1s Albania responsible under international law for
the explosions which occurred on the 22nd October 1946 in
Ybanian waters and for the darnage and loss of human life
which resulted from them and is there any duty to pay
compensation ?
(2) Has the United Kingdom under international law
violated the sovereignty of the Albanian People's Republic
by reason of the acts of the Royal Navy in Albanian waters
on the ~2nd October and on the 12th and 13th November
1946 and is there any duty to give satisfaction ?
The Parties agree that the present Special Agreement shall
be notified to the International Court of Justice immediately
after the delivery on the 25th March of its judgment on the
question of jurisdiction.
The Parties request the Court, having regard to the present
Special Agreement, to make such orders with regard to procedure,
in conformity with the Statute and the Rules of the Court, as
the Court may deem fit, after having consulted the Agents of
the Parties.
In witness whereof the above-mentioned Agents, being duly
authorized by their Governments to this effect, have signed the
present Special Agreement.
Done this 25th day of March, 1948, at mid-day, at The Hague,
in English and French, both texts being equally authentic, in
a single copy which shall be deposited with the International
Court of Justice."

Whereas this Special Agreement now forms the bais of further
proceedings before the Court in this case, and States the questions
which the Parties have agreed to submit to the Court for decision ;
Whereas the United Kingdom Govemment, on October rst, 1947,
that is within the time-limit fixed by the Court, filed a Memorial
with statements and submissions relating to the incident that
occurred on October zznd, 1946 ;
Whereas the Agents for the Parties, having in view the filing of
the Memorial and having been consulted by the President, declared
in his presence that they agreed in requesting that the order and
time-limits for the filing of the subsequent pleadings as fixed by
the Judgment of March zsth, 1948, be maintained ;
confirms the time-limits for the filing of the subsequent plead-
ings as follows :
(a) for the Counter-Memorial of the Albanian Government,
Tuesday, June 15th, 1948 ;
(b) for the Reply of the United Kingdom Govemment, Monday,
August znd, 1948 ;
(c) for the Rejoinder of the Albanian Government, Monday,
September zoth, 1948.
Done in English and French, the English text being authoritative,
at the Peace Palace, The Hague, this twenty-sixth day of March,
one thousand nine hundred and forty-eight, in three copies, of
which one will be placed in the archives of the Court and the others
will be transmitted to the Govemments of the People's Republic
of Albania and of the United Kingdom of Great Britain and
Northem Ireland respectively.

La Cour internationale de Justice,
Après délibéréen Chambre du Conseil,
Vu les articles40 et 48 du Statut de la Cour,
Rend l'ordonnancesuivante :
Considérant que, par requête du 22 mai 1947, conformément à
l'artic40, paragraphe 1, du Statut, et à l'article 32, paragra2,e
du Règlement, le Gouvernement du Royaume-Uni de Grande-
Bretagne et d'Irlande du Nord a introduit devant la Cour contre le
Gouvernement de la République populaire d'Albanie une instance
concernant l'incident survenu dans le détroit de Corfou le
22 octobre 1946, au cours duquel deux contre-torpilleurs britan-
niques heurtèrent des mines dont l'explosion causa des dommages
à ces navires ainsi que de lourdespertes de vies humaines ;
Considérant qu'à la date du reroctobre 1947 le Gouvernement
<luRoyaume-Uni avait déposéun Mémoire contenant un exposé
et des conclusions;
Considérant que, dans le délai prévu pour le dépôt du Contre-
MCmoire,l'agent du Gouvernement albanais, par un document daté
du IC~décembre 1947 et enregistré au Greffe gedécembre 1947, a
présenté une exception préliminaire de non-recevabilité de la
requête;
Considérant que, par Arrêt du 25 mars 1948, la Cour a rejeté
ladite exception préliminaire, décidé que la procédure sur le fond
serait poursuivie, et fixé commesuit les délais pour le dépôt des
pièces ultérieures

Considérant qu'après le prononcé dudit arrêt, la Cour a reçu de
la part de l'agent du Gouvernement de l'Albanie et de l'agent du
Gouvernement du Royaume-Uni notification d'un compromis en
date du 25 mars 1948;
Considérant que le compromis en question est ainsi conçu :
(Le Gouvernement de la République populaire d'Albanie,
représentépar son agent M. Kahreman Ylli, envoyéextraordinaire
et ministre plénipotentiaire d'Albanie à Paris;
et
le Gouvernement du Royaume-Uni de Grande-Bretagne et
d'Irlande du Nord, représenté par M. IV. E. Beckett, C.M.G.,
K. C., jurisconsulte au Foreign O&ce;
Sont convenus par le présent compromis, établi à la suite de
la Résolution du Conseil de Sécurité dug avril 1947, de soumettre
à la Cour internationale de Justice, aux fins de jugement, les
questions suivantes :
1) L'Albanie est-elle responsable selon le droit international
des explosions qui ont eu lieu le 22 octobre 1946 dans les
eaux albanaises, et des dommages et pertes humaines qui en
seraient suivis, et y a-t-il le cas de réparations à donner ?
2) Le Royaume-Uni a-t-il violé,selon le droit international,
la souveraineté de la République populaire d'Albanie par les
actions de la marine de guerre britannique dans les eaux
albanaises le22 octobre 1946 et les 12 et 13 novembre 1946
et y a-t-il lieuà donner satisfaction ?
Les Parties sont d'accord que le présent compromis sera soumis
à la Cour internationale de Justice immédiatement après que la
Cour rendra son arrêt,le 25 mars, relatifà l'exception préliminaire.
Les Parties demandent à la Cour, eu égard au présent com-
promis, de prendre, conformément au Statut et au Règlement
de la Cour, et après avoir consulté les agents des Parties, des
dispositions qu'elle jugera appropriées pour la procédure à suivre.
En foi de quoi, les agents sus-mentionnés, dûment autorises
par leurs Gouvernements, ont signé le présent compromis.
Fait à La Haye, le 25 mars 1948, àmidi, en français et enanglais,
les deux textes faisant également foi, en un seul exemplaire qui

laquelle la Cour devra connaître de ladite affaire et énonce les
questions que les Partiessont convenuesde soumettre àsa décision ;
Considérant qu'à la date du Ier octobre 1947, dans le délai
prescrit par la Cour, le Gouvernement du Royaume-Uni avait
déposéun Mémoirecontenant un exposéet des conclusions relatifs
à l'incident survenu le 22 octobre 1946 ;
Qu'en considération du dépôt de ladite pièce, les agents des
Parties, consultéspar le Président, se sont déclarésd'accord devant
lui pour demander que soient maintenus l'ordre et les délais de
présentation des pièces ultérieures fixéspar l'Arrêtdu 25 mars
1948 ;
confirme comme suit les délais pour la présentation des pièces
ultérieures :
a) pour le Contre-Mémoiredu Gouvernement albanais, le mardi
