The PRESIDENT opened the Sitting and stated that the Court had
met to deliverhe Advisory Opinion requested by the General Assembly
of the United Nations in the matter of the Voting Procedure on Ques-
tions relating to Reports and Petitions concerning the Territory of
South-West Africa.
He called upon the Registrar to read the resolution of the General
Assembly of Sovember ~3rd. 1954, requesting the Opinion.
The REGISTRAR read the relevant text.
The PRESIDEXT stated that in pursuance of Article 67 of the Statute,
notice had been given to the Secretary-General of the United Nations
that the Advisory Opinion would be delivered thi day in open court.
In accordance with Article 39 of thetute, the Court had decided
that the English i:extof the Opinion should beconsidered asauthoritative.
He would read that text.
The PRESIDENT read the relevant text.
The PRESIDEKT called upon the Registrar to read the French text
of the operative clause.
The REGISTRAR read the relevant text.
The PRESIDEXTstated that Judge Kojevnikov declared that he
subscribed to the Opinion which the Court had given on Quest(a)
asked by the General Assembly of the United Xatioiis on November ~3rd.
1954. He would, however, like to indicate that the fact that he had
voted in favouri~the final part of the Advisory Opinion did not mean
that he agreed with al1that had been said, or with the reasoning advanced
in al1 resuects. nor that he acknowledeed the correctness of the whole
of the A&iso& Opinion of July ~rth, f950.
Judge Kojevnikov did not share the view, expressed in the Court's
Advisory Opinion of 1950, that the provisions.of Chapter XII of the
Charter do not impose a legal obligation on the Union of South Africa
to place the Tersitory under the Trusteeship System. On the contrary,
he considered that the Charter of the United Nations imposes on the
Union of South .4frica the obligation to place the Territory of South-

des Nations Unies le 23 novembre 1954..Mais il voudrait cependant
relever que son vote positif pour la partie finale de l'avis consultatif
nesignifiepas qii'ilsoit d'accord avec toutes lesdonnéeset tout l'ensemble
des motifs, ni qu'il reconnaisse la justesse de toutes les parties de I'avis
consultatif dII juillet 1950.
II ne partage pas I'avis de 1950 de la Cour que les dispositions du
tion juridique de placer le territoire sous lerégimede tutelle. Au contraire,
il trouve que la Charte des Xations Unies imào1'Unioiisud-africaine
l'obligation de placer sous Ic régime de tutelle le Territoire dii Sud-

appended to the Opinion of the Court statements of their separate
opinions.
The authon of these opinions had informed the President that they
did not wish them to be read at this sitting.
