The International Court of Justice, Composed as above, After deliberation, Having regard to Articles 48, 65 and 66 of the Statute of the Court and to Articles 104 and 105 of the Rules of Court, Makes the following Order: Whereas on 30 December 2022 the United Nations General Assembly adopted, at the 56th meeting of its Seventy-seventh Session, resolution 77/247, by which it decided, pursuant to Article 65 of the Statute of the Court, to request the International Court of Justice to render an advisory opinion; - 2 - Whereas certified true copies of the English and French texts of that resolution were transmitted to the Court under cover of a letter from the Secretary-General of the United Nations dated 17 January 2023 and received on 19 January 2023; Whereas paragraph 18 of this resolution reads as follows: “The General Assembly, . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . 18. Decides, in accordance with Article 96 of the Charter of the United Nations, to request the International Court of Justice, pursuant to Article 65 of the Statute of the Court, to render an advisory opinion on the following questions, considering the rules and principles of international law, including the Charter of the United Nations, international humanitarian law, international human rights law, relevant resolutions of the Security Council, the General Assembly and the Human Rights Council, and the advisory opinion of the Court of 9 July 2004: (a) What are the legal consequences arising from the ongoing violation by Israel of the right of the Palestinian people to self-determination, from its prolonged occupation, settlement and annexation of the Palestinian territory occupied since 1967, including measures aimed at altering the demographic composition, character and status of the Holy City of Jerusalem, and from its adoption of related discriminatory legislation and measures? (b) How do the policies and practices of Israel referred to in paragraph 18 (a) above affect the legal status of the occupation, and what are the legal consequences that arise for all States and the United Nations from this status?”; Whereas the Secretary-General indicated in his letter that, pursuant to Article 65, paragraph 2, of the Statute, all documents likely to throw light upon the questions would be transmitted to the Court in due course; Whereas, by letters dated 19 January 2023, the Registrar gave notice of the request for an advisory opinion to all States entitled to appear before the Court, pursuant to Article 66, paragraph 1, of the Statute, 1. Decides that the United Nations and its Member States, as well as the observer State of Palestine, are considered likely to be able to furnish information on the questions submitted to the Court for an advisory opinion and may do so within the time-limits fixed in this Order; 2. Fixes 25 July 2023 as the time-limit within which written statements on the questions may be presented to the Court, in accordance with Article 66, paragraph 2, of the Statute; 3. Fixes 25 October 2023 as the time-limit within which States and organizations having presented written statements may submit written comments on the written statements made by other States or organizations, in accordance with Article 66, paragraph 4, of the Statute; and Reserves the subsequent procedure for further decision. - 3 - Done in English and in French, the English text being authoritative, at the Peace Palace, The Hague, this third day of February, two thousand and twenty-three. Vu les articles 48, 65 et 66 du Statut de la Cour et les articles 104 et 105
de son Règlement,
Rend l’ordonnance suivante :
Considérant que, le 30 décembre 2022, l’Assemblée générale des Nations
Unies a adopté, à la 56e séance de sa soixante-dix-septième session, la résolution
77/247, par laquelle elle a décidé, conformément à l’article 65 du
Statut, de demander à la Cour internationale de Justice de donner un avis
consultatif ;
Considérant que des copies certifiées conformes des versions française et
anglaise de la résolution susmentionnée ont été transmises à la Cour sous
le couvert d’une lettre du Secrétaire général des Nations Unies datée du
17 janvier 2023 et reçue le 19 janvier 2023 ;

Whereas paragraph 18 of this resolution reads as follows:
“The General Assembly,

18. Decides, in accordance with Article 96 of the Charter of the
United
Nations, to request the International Court of Justice, pursuant
to Article 65 of the Statute of the Court, to render an advisory opinion
on the following questions, considering the rules and principles of international
law, including the Charter of the United Nations, international
humanitarian law, international human rights law, relevant resolutions
of the Security Council, the General Assembly and the Human Rights
Council, and the advisory opinion of the Court of 9 July 2004:
(a) What are the legal consequences arising from the ongoing violation

Whereas the Secretary-General indicated in his letter that, pursuant to
Article
65, paragraph 2, of the Statute, all documents likely to throw light

Whereas, by letters dated 19 January 2023, the Registrar gave notice of
the Request for an advisory opinion to all States entitled to appear before the
Court, pursuant to Article 66, paragraph 1, of the Statute,

on the questions submitted to the Court for an advisory opinion and

Considérant que le paragraphe 18 de cette résolution est ainsi libellé :
« L’Assemblée générale,

Unies, de demander à la Cour internationale de Justice de donner, en
vertu de l’Article 65 du Statut de la Cour, un avis consultatif sur les questions
ci-après, compte tenu des règles et principes du droit international,
dont la Charte des Nations Unies, le droit international humanitaire, le
droit international des droits de l’homme, les résolutions pertinentes du
Conseil de sécurité et du Conseil des droits de l’homme et les siennes
propres, et l’avis consultatif donné par la Cour le 9 juillet 2004 :
a) Quelles sont les conséquences juridiques de la violation persistante
par Israël du droit du peuple palestinien à l’autodétermination, de
son occupation, de sa colonisation et de son annexion prolongées du
territoire palestinien occupé depuis 1967, notamment des mesures
visant à modifier la composition démographique, le caractère et le
statut de la ville sainte de Jérusalem, et de l’adoption par Israël des
lois et mesures discriminatoires connexes ?
b) Quelle incidence les politiques et pratiques d’Israël visées au
paragraphe
18 a) ci-dessus ont-elles sur le statut juridique de l’occupation
et quelles sont les conséquences juridiques qui en découlent
pour tous les États et l’Organisation des Nations Unies ? » ;
Considérant que le Secrétaire général a indiqué dans sa lettre que, conformément
au paragraphe 2 de l’article 65 du Statut, tout document pouvant
servir à élucider les questions serait transmis à la Cour en temps utile ;
Considérant que, par lettres en date du 19 janvier 2023, le greffier a notifié
la requête pour avis consultatif à tous les États admis à ester devant la Cour,
conformément au paragraphe 1 de l’article 66 du Statut,
1. Décide que l’Organisation des Nations Unies et ses États Membres,
ainsi
que l’État observateur de Palestine, sont jugés susceptibles de fournir
des renseignements sur les questions soumises à la Cour pour avis
consultatif et qu’ils pourront le faire dans les délais fixés par la présente
ordonnance ;
2. Fixe au 25 juillet 2023 la date d’expiration du délai dans lequel des
exposés
écrits sur les questions pourront être présentés à la Cour conformément
au paragraphe 2 de l’article 66 de son Statut ;
3. Fixe au 25 octobre 2023 la date d’expiration du délai dans lequel
les États ou organisations qui auront présenté un exposé écrit pourront présenter
des observations écrites sur les exposés écrits faits par d’autres
États et organisations conformément au paragraphe 4 de l’article 66 du
Statut ;
Réserve la suite de la procédure.
