Having regard to Articles 48 andf the Statule of the Court and to
Articles 103and 104 of theles of Court,

Makes thejollowin;: Order:

Whereas on 8 December 2003 the United Nations General Assembly
adopted resolution AIRESIES-10114, whereby itcided, pursuant to
Article5 of the Statuite of the Court, to request the International Court
of Justice to give anent advisory opinion on the following question:

"What are the llegalconsequences arising from the construction of CONSTRUCTION OF A WALL (ORDER 13 XII 03) 429

the wall being built by Israel, the occupying Power, in the Occupied
Palestinian Territory, including in and aroiind East Jerusalem, as
described in thie report of the Secretary-Ganeral, considering the
rules and principles of international law, including the Fourth
Geneva Convention of 1949, and relevant Security Council and
General Assembly resolutions?";

Whereas certified true copies of the English aiid French texts of that
resolution, and of the report of the Secretary-Geiieral referred to therein
(AIES-101248)were transmitted to the Court undcr cover of a letter from
the Secretary-General of the United Nations date i 8 December 2003 and
received in the Registry by facsimile on 10 Decenber 2003, the original
thereof having reached the Registry subsequentlq ;

Whereas the Secretary-General indicated in his letter that, pursuant to
Article 65, paragraph 2, of the Statute, al1documents likely to throw light
upon the question would be transmitted to the Ccurt as soon as possible;

Whereas, in view of the fact that the General Assembly has requested
that the advisory opinion of the Court be rendered "urgently", it is
incumbent upon the Court to take al1necessary steps to accelerate the
procedure, as contemplated by Article 103of its Rules,

1. Decides that the United Nations and its hfember States are con-
sidered likely, in accordance with Article 66, paragraph 2, of the Statute,
to be able to furnish information on al1aspects raised by the question
submitted to the Court for advisory opinion; antlfixes 30 January 2004
as the time-limit wiithin which they may submit to the Court written
statements on the question;
2. Decides further that, in light of General Assembly resolution

AIRESIES-10114and the report of the Secretary-General transmitted to
the Court with the request, and taking into accourit the fact that the Gen-
eral Assembly has granted Palestine a special status of observer and that
the latter isco-sponsor of the draft resolution iequesting the advisory
opinion, Palestine niay also submit to the Court a written statement on
the question within the above time-limit;
3. Drcidps, in accordance with Article 66, parzgraph 4, of the Statute
and Article 105of the Rules of Court, to hold hearings during which oral
statements and comments may be presented to tlie Court by the United
Nations and its Meimber States, regardless of wt-ether or not they have
submitted written st,atements; and$flues23 Februi~ry2004 as the date for
the opening of the said hearings;
4. Decldes further that, for the reasons set out above, Palestine may
also take part in the hearings due to open on 23 February 2004;

5. Invites the Uriited Nations and its Member States, as well as CONSTIRUCTION OF A WALL (ORDER 1'XII 03) 430

Palestine, to inform the Registry, by 13 Februaiy 2004 at the latest, if
they are intending to take part in theabove-men*ioned hearings; and

Reserves the subsequent procedure for further decision.

Done in French and in English, the French text being authoritative,
at the Peace Palace, The Hague, this nineteenth day of December, two

qu'Israël, puissance occupante, est en train de construire dans leTer-
ritoire palestinien occupé, compris à l'intérieuret sur le pourtour
de Jérusalem-Est, selon ce qui est exposédans le rapport du Secré-
taire général,compte tenu des règleset des principes du droit inter-
national, notamment la quatrième convention de Genève de1949,et

les résolutionsconsacréesAla question par le Conseil de sécurité et
l'Assembléegénérale? »;
Considérant que des copies certifiéesconformes des versions française
et anglaise de la résolution susmentionnée,et du rapport du Secrétaire

généralauquel elle fait référence(document AIES-10/248),ont ététrans-
mises à la Cour sous le couvert d'une lettre du Secrétaire général des
Nations Unies datéedu 8 décembre2003 et reçue au Greffe par télécopie
le 10 décembre 2003, dont l'original est parvenu au Greffe ultérieure-
ment;
Considérant que le Secrétaire généraa l indiqué dans sa lettre que,
conformément au paragraphe 2 de I'article 65 du Statut, tout document
pouvant servir à éluciderla question serait transmis à la Cour dès que

Considérant que, l'Assemblée générale ayant demandé que l'avis
consultatif de la Cour soit rendu «d'urgence», il échetpour celle-ci de
prendre toutes mesures utiles pour accélérer laprocédure, ainsi qu'il est
prévu à l'article 103du Règlement,

1.Décide que l'organisation des Nations Unies et ses Etats Membres
sont jugés,conformément au paragraphe 2 de I'article 66 du Statut, sus-
ceptibles de fournir des renseignements sur l'ensemble desaspects soule-
véspar la question soumise à la Cour pour avis consultatif; et ,fixe au
30janvier 2004 la date d'expiration du délaidans lequel ilspourront sou-

mettre à la Cour des exposés écritssur la question;
2. Dkcidp par ailleurs que, au vu de la résolutionAIRESIES-10114de
l'Assemblée générale edtu rapport du Secrétaire génératlransmis à la
Cour avec la requête,et compte tenu du fait que l'Assemblée généralae
accordé Ala Palestine un statut spéciald'observateur et que celle-ci est
coauteur du projet de résolution demandant l'avis consultatif, la Pales-
tine pourra égalementsoumettre à la Cour un exposé écritsur la question
posée,dans le délaisus-indiqué;
3. Dkciclc,conformémentau paragraphe 4 de l'article 66 du Statut et a
I'article 105du Règlement, de tenir des audiences au cours desquelles des
exposés et observations pourront êtreprésentésdevant la Cour par
l'organisation des Nations Unies et ses Etats Membres, qu'ils aient ou

non déposédes exposésécrits;etJïxe au 23 février2004 la date d'ouver-
ture desdites audiences;
4. Dkcidp par ailleurs que, pour les motifs exposés ci-dessus, la Pales-
tine pourra également participer à la procédure orale qui s'ouvrira le
23 février 2004;
