Application for Iieview of Judgeaent No. 273 of the
Unit ecl Nations A&~.inistretive Tribunal
The following informrztiori is communicated to the Press by the
Registry of the International Court of Justice:
On 28 July 1981 the Court received a request for advisory ox~inion
on an administrative issuc from a,n organ of the United Nations General
Assembly .
The orGan in question is the Co~nmittee on A-pplications for Review
of Administrative TribunaIl Judgemerits, wl~ich is authorized to ask the
Court for advisory opinions by virtue of Article 96 of the United Nations
Charter.
In accordance with tlie procedure laid down by Article 11 of the
Statute of the United Nations Adxinistrative Tribunal, the tribunal for
the settlement of disputes between the United Nations Secretary-General
and staff inembers of the Organization concerning their conditions of
employment, the Cornmittee may Le asked to request an advisory opinion
from the Court in connect.ion with th(: juiigenent af the triburial if a
merilber State, the United Wations Secre-tary--Genersl, or the staff rnember
in respect of whom thc judgement was renderea, Uisputes the judgement.
If the Committee considers that thers is a substantial basis for a
request, it brings the ma-tter before the Court. In the present case it
was the Goverraent of the United States which male an ~pplication to the
Cornittee for review of Jildgernent No. 273? given by the Administrative
Tribmal on 15 Ivlay198 1 .
The case in question relates to the payment to a former United Nations
staff member on his retirernent of what is knowil as the repatriation grant.
The Secretary-General of the United Nations i~zving refused it on the basis
the judgement nevertheless
of a resolution of the Gerleral Assembly,
recognized the right of the staff member to the sayment of this grsnt as
an acquired right.

On. .. On 13 July 1981 the Cormittee decided th& there was a substantisl
besis for the application presented by the United States, and adopted a
decision by which it requested the Court tu &ive an advisrry opinion on
the fcllowing question:
"1s the judgenent of the United Nations Adninistra-tive Tribunal
in Judgeaent No. 273, Mcrtished v. the Secretary-Genéral, warranted
in determining that Generel Assem$ly resclution 34/ 165 of 17 December
1979 could not 'ce given inmediate effect in requiring, for the payment
of repatriation grsnts, evidence of rslocation to a country other than
the country cf tne staff meniber's last duty station?"
By an Order of 6 August 1Ç81, ~ursuant to Article 66, paragraph 2,
of the Statute of the Co-drt, t'ne President of the Court fixed 30 October
1981 as the tirne--1imit t~ithin which written statements may be submitted
The subsequent procedure
by the Ucited Nations and by its member States,
is reserved for furthcr decision.
When the Court gives its advisory opinion, the Secretary-General
will either give zffect to it, or request the Adninistrative Tribunal
to convene specially in order t~ confirri its oricinal judgement or to
give a new judgenent in conformity with the opinion of the Court.
This is the second tirae thst the Court has been asked for an edvisory
opinion by the Cornittee on Applications for Review QI Administrative
Tribunal Judgenents. The first case concerned the Application for tliê
Revicw of Sudgeoient No. 158 of the United Nations Administrative Tribunal
(I.C.J. Reports 1973, p. 166). It was brought bef'ore the Court on
3 Juïy 1972, anfi the advisory opinion was given on 12 July 1973. That
case related to the question of indennity for a fomer UN staff mcmber
