(DEMOCRATIC REPUBLIC OF THE CONGO v.BURUNDI)

ORDER

The President of the International Court of Justice,

Having regard to Article 48 of the Statute of the Court and to
Article44, paragraphs 3 and 4,of the Rules of Court,
Having regard to the Application filed in the Registry of the Court on
23 June 1999. whereby the Democratic Republic of the Congo instituted

proceedings against the Republic of Burundi in respect of a dispute con-
cerning "acts ofurrned uggressionperpetrated by Burundi on the terri-
tory of the Democratic Republic of the Congo, in flagrant violation of
the United Nations Charter and of the Charter of the Organization of
African Unity",

Having regard to the Order of 21 October 1999, whereby the Court,
taking into account the agreement concerning the procedure reached
between the Parties. and their views regarding the time-limits to be fixed,
decided that the written proceedings would first be addressed to the ques-
tions of the jurisdiction of the Court to entertain the Applicand of
its admissibility, and fixed 21 April 2000 and 23 October 2000 respec-

tively as the time-limits for the filing of the Memorial of the Republic of
Burundi and the Counter-Memorial of the Democratic Republic of the
Congo on those questions.
Having regard to the Memorial of the Republic of Burundiwhich was

filed within the time-limit thus fixed;
Whereas, by a letter dated 6 October 2000, received in the Registry onthe same day by facsimile, the Agent of the Democratic Republic of the
Congo requested the Court to extend by a period not exceeding four
months the time-limit for the filing of the Counter-Mernorial, and indi-
cated the reasons for that request; and whereas, on receipt of that letter,
the Registrar, referring to Article 44, paragraph 3, of the Rules of Court,
transmitted a copy thereof to the Agent of the Republic of Burundi;

Whereas the Government of the Republic of Burundi did not object to
the extension of time-limit requested by the Democratic Republic of the
Congo,

Memorial of the Democratic Republic of the Congo; and

Re.rrrvrs the subsequent procedure for further decision.

the Peace Palace, The Hague, this nineteenth day of October, two thou-
sand, in three copies, one of which will be placed inthe archives of the
Court and the others transmitted to the Government of the Democratic
Republic of the Congo and the Government of the Republic of Burundi,
respectively.

ORDONNANCE

Le président de la Cour internationale de Justice,

Vu l'article8 du Statutde la Cour et les paragraphes 34ede l'article
44 de son Règlement,
Vu la requêteenregistrée au Greffe de la Cour le 23 juin 1999, par
laquelle la République démocratique du Congo a introduit une instance

contre la République du Burundi au sujet d'un différend relatif à «des
actes d'agrrssion armée perpétréspar le Burundi sur le territoire de la
République démocratique du Congo en violation flagrante de la Charte
des Nations Unies et de la Charte de l'organisation de l'unité africaine)),

Vu l'ordonnance du 21 octobre 1999, par laquelle la Cour, compte
tenu de l'accord intervenu entre les Parties au sujet de la procédure, ainsi
que de leurs vues quant aux délaisa fixer, a décidéque les pièces de la
procédure écrite porteraient d'abord sur la question de la compétence de
la Cour pour connaître de la requête etsur celle de la recevabilitéde cette
dernière, et a fixé,respectivement, au 21 avril 2000 et au 23 octobre 2000

les dates d'expiration des délaispour le dépôt du mémoire de la Répu-
blique du Burundi et du contre-mémoire de la République démocratique
du Congo sur ces questions,
Vu le mémoirede la République du Burundi déposédans le délai ainsi
fix;

Considérant que, par lettre du 6 octobre 2000, parvenue au Greffe le INTERNATIONAL COURT OF JUSTICE

Congo a priéla Cour de proroger de quatre mois maximum le délaipour
le dépôt du contre-mémoire, et a indiqué les raisons à l'appui de cette

demande; et considérant que, dès réceptionde cette lettre, le greffier, se
référantau paragraphe 3 de l'article44 du Règlement, en a fait tenir
copie à l'agent de la République du Burundi;
Considérant que le Gouvernement de la République du Burundi n'a

pas fait objection à la prorogation de délai sollicitéepar la République
démocratique du Congo,

Reporte au 23 janvier 2001 la date d'expiration du délaipour le dépôt
du contre-mémoire de la République démocratique du Congo;
RPscrvr la suite de la procédure.

Fait en français et en anglais, le texte français faisant foi, au Palais de
la Paix,iiLa Haye, le dix-neuf octobre deux mille, en trois exemplaires,
dont l'un restera déposéaux archives de la Cour et les autres seront
transmis respectivement au Gouvernement de la République démocra-
tique du Congo et au Gouvernement de la République du Burundi.
