ORDER

The Vice-President of the International Court of Justice, Acting Presi-
dent,

Having regard to Article 48 of the Statute of the Court and to
Articles 31 and 79 of the Rules of Court,

Having regard to theOrder of 30 June 1999, whereby the Court fixed
5 January 2000 and 5 July 2000 as the time-limits for the filing, respec-
tively, of a Memorial by the Federal Republic of Yugoslavia and of a
Counter-Memorial by the Portuguese Republic;

Whereas on 5 July 2000 Portugal filed certain preliminary objections to
jurisdiction and to admissibility;
Whereas accordingly, by virtue of Arti79,paragraph 3, of the Rules
of Court, the proceedings on the merits are suspended and a time-limit
has to be fixed for the presentation by the other Party of a written state-

ment of its observations and submissions on the preliminary objections;

Whereas, at a meeting between the Vice-President, Acting President,
and the Agents of the Parties, held on6 September 2000, Yugoslavia
indicated that it would require nine months for the preparation of that

written statement; and whereas Portugal did not object to such a time-
limit being fixed, but stressed that it expected that Yugoslavia would pro-
vide specific answers to the preliminary objections made by the Portu-
guese Government, Taking account of the views of the Parties and the special circum-
stances of the case,

Fixes 5 April 2001 as the time-limit within which the Federal Republic
of Yugoslavia may present a written statement of its observations and
submissions on the preliminary objections made by the Republic of
Portugal ; and
Rrserves the subsequent procedure for further decision.

Done in English and in French, the English text being authoritative, at
the Peace Palace, The Hague, this eighth day of September, two thou-
sand, in three copies, one of which will be placed in the archives of the
Court and the others transmitted to the Government of the Federal
Republic of Yugoslavia and the Government of the Portuguese Republic,
respectively.

ORDONNANCE

Le vice-président de la Cour internationale de Justice, faisant fonction
de président en l'affaire,

Vu l'articl48 du Statut de la Cour et les articles 31 et 79 de son Règle-
ment,

Vu l'ordonnance du 30 juin 1999, par laquelle la Cour a fixéa5jan-
vier 2000 et au 5 juillet 2000 les dates d'expiration des délais pour le
dépôt, respectivement, d'un mémoirede la République fédéralede You-
goslavie et d'un contre-mémoire de la République portugaise;

Considérant que, le5juillet 2000, le Portugal a déposécertaines excep-
tions préliminaires d'incompétence et d'irrecevabilité;
Considérant qu'en conséquence, en vertu des dispositions du para-
graphe 3 de l'article 79 du Règlement de la Cour, la procédure sur le fond

est suspendue et qu'il échetde fixer un délaidans lequel la Partie adverse
pourra présenter un exposé écritcontenant ses observations et conclu-
sions sur les exceptions préliminaires;
Considérant que, au cours d'une réunion que le vice-président, faisant
fonction de président en l'affaire a tenue avec les agents des Parties le

6 septembre 2000, la Yougoslavie a indiquéqu'elle aurait besoin de neuf
mois pour la préparation de cet exposé écrit; et considérant que le
Portugal n'a pas fait objection à ce qu'un tel délai soit fixé,tout en
soulignant qu'il attendait de la Yougoslavie que celle-ci réponde spéci-
fiquement aux exceptions préliminaires soulevéespar le Gouvernement
