The International Court of Justice,

Composed as above,
Having regard to Article 48 of the Statute of the Court and to
Article 89 of thees of Court,

Having regard to the Application filed in the Registry of the Court on
3 April 1998,whereby the Republic of Paraguay instituted proceedings
against the United States of America for "violations of the Vienna Con-
vention on Consular Relations [ofpril 19631"allegedly committed
by the United States,
Havingregard to the request for the indication of provisional measures
submitted by Paraguay on 3 April 1998and to the Order made by the
Court on 9 April 1998, by whichit indicated provisional measures,

Havingregard to the Orders of 9 April 1998and 8 June 1998,by whichthe Vice-President of the Court, acting as President, fixed and subse-
quently extended the time-limitsfor the filing of written pleadings on the
merits, and having regard to the Memorial filed by Paraguay on 9 Octo-

ber 1998 ;
Whereas, by a letter of 2 November 1998, filed in the Registry that
same day, the Agent of Paraguay informed the Court that his Govern-
ment wished to discontinue the proceedings with prejudice, and accord-
ingly requested that the case be removed from the List;

Whereas a copy of this letter was immediately communicated to the
Government of the United States, which was informed that the senior
judge, acting pursuant to Articles 13,paragraph 3, and 89, paragraphs 2
and 3, of the Rules of Court, had fixed 30November 1998as the time-
limit within which the United States could state whether it opposed the
discontinuance ;
Whereas, by a letter of 3 November 1998,a copy of which wasfiled in
the Registry that same day, the Agent of the United States informed the
Court that his Government concurred in Paraguay's discontinuance of

the proceedingswith prejudice,and in its request that the casebe removed
from the List,
Places on record the discontinuance by the Republic of Paraguay of
the proceedings instituted by the Application filed on 3 April 1998; and

Orders that the case be removed from the List.

Done in English and in French, the English text being authoritative, at
the Peace Palace, The Hague, this tenth day of November, one thousand
nine hundred and ninety-eight, in three copies, one of which will be
placed in the archives of the Court and the others transmitted to the
Government of the Republic of Paraguay and the Government of the
United States of America, respectively.

Vu la demande en indication de mesures conservatoiresparésentée
le Paraguay leavril 1998et l'ordonnance renduepar la Cour le 9 avril
1998,aux termes de laquelleelle a indiquédes mesures conservatoires,
Vu les ordonnances du 9 avril 1998et du 8juin 1998,par lesquelleslethe Vice-President of the Court, acting as President, fixed and subse-

Considérant que,par lettre du 2 novembre 1998,déposée au Greffe le
même jour, l'agent du Paraguay a fait savoir la Cour que son gouver-
nement souhaitait se désister de l'instanceet renoncer toute action en
l'affaire, et qu'il demandait en conséquenceque l'affaire soit rayéedu
rôle;

Considérant que copie de cette lettre a immédiatementété adresséeau
Gouvernement des Etats-Unis, qui a été informé que lejugd eoyen, agis-
sant en application des articles 13, paragraphe 3, et 89, paragraphes2
et 3, du Règlement,avait fixéau 30 novembre 1998la date d'expiration
du délaidans lequel les Etats-Unis pouvaient déclarers'ilss'opposaient
au désistement;

Considérant que,par lettre du 3 novembre 1998,dont une copie a été
déposée au Greffele même jour, l'agentdes Etats-Unis a informélaCour
que son gouvernementacceptait le désistementdu Paraguay de l'instance
et la renonciation de sa part à toute action en l'affaire, ainsi que sa
demande tendant à ce que l'affaire soit rayéedu rôle,

Prend actedu désistementde la Républiquedu Paraguay de l'instance
introduite par la requêteenregistréele3 avril 1998;
Ordonneque l'affaire soit rayéedu rôle.

Fait en anglaiset en français, le texte anglaisfaisant foi, au Palais de la
Paix, àLa Haye, le dix novembre mil neuf cent quatre-vingt-dix-huit, en

trois exemplaires, dont l'un restera déposé auxarchives de la Cour et
les autres seront transmis respectivement au Gouvernement de la Répu-
blique du Paraguay et au Gouvernement des Etats-Unis d'Amérique.
