Havingregard tothe Application filed bythe Republic of Nicaragua on

28July 1986bywhich the proceedings in this case were instituted against
the Republic of Honduras,
Havingregard to the Judgment delivered bythe Court onmber
1988bywhich it found that it had jurisdiction to entertain that Applica-
tion, and that that Application was admissible,

Having regard to the Orders made by the President of the Court on
21April and31August 1989bywhichtime-limits for written proceedings
on the merits werefixed and subsequently extended, and havingregard to
the Memorial filed by Nicaragua on 8 December 1989,
Havingregard totheagreementbetween the Parties dated 12December
1989,notified to the Court onecember 1989,providing (interalia)
that the Parties would immediately request the postponement of the datefor the fixing of the time-limit for the Counter-Memorial of Honduras
until 11June 1990,and that if no extra-judicial settlement of the dispute
had been reached by that date, either Party might request that Honduras

be granted sixmonths forthe filing of its Counter-Memorial,

Havingregard to the Order made bythe Court on 14December 1989by
which the Court, taking into account the said agreement,decided that the
time-limit for theCounter-Memorial of Honduras was extended from the
date originallyfixed (19February 1990)toadate to be fixed byan order to
be made after II June 1990;

Whereas neither Party has since requested the Court to fix the time-
limit for the Counter-Memorial;
Whereas by a letter dated 11May 1992,and receivedin the Registrythe
followingday,the AgentofNicaraguainformedthe Court that, taking into
considerationthatthePartieshad reached anout-of-court agreementaimed
at enhancing their good neighbourly relations, the Government of Nicar-
aguahad decided torenounce al1further right ofactionbased on the case,
and that that Government did not wish to go on with the proceedings;

Whereas a copy ofthat letter wasforthwith transmitted bythe Registrar
to the Government of Honduras, which was informed that the President
of the Court had fixed 25 May 1992as the time-limit within which the
Government might state whether it opposed discontinuance of the pro-
ceedings ;

Whereas by a letter dated 14May 1992,transmitted to the Registrar by
facsimile on 18May 1992,the Co-Agent of Honduras informed the Court
that his Government did not oppose discontinuance of the proceedings,
Places on recordthe discontinuance bythe Republic of Nicaragua ofthe
proceedings instituted by the Application filed on 28July 1986;and

Ordersthat the case be removed from the list.

Done in English and in French, the Englishtext being authoritative,at
the Peace Palace,The Hague, this twenty-seventh day of May, one thou-
Sandnine hundred and ninety-two,in three copies, one of which will be
placed in the archives of the Court and the others transmitted to the

Considérantque, parune lettre datéedu 11mai 1992,reçue au Greffele

jour suivant,l'agent du Nicaraguaa informé laCour que,tenant compte
de ceque les Partiesétaientparvenuesà un accord extrajudiciairevisanà
favoriserleursrelations debon voisinage, leGouvernement du Nicaragua
avait décidéde renoncer à faire valoir tous autres droits fondéssur cette
affaire,et qu'il ne souhaitait pas poursuivre la procédure;
Considérantque copie de ladite lettre a été communiquée aussitôptar
leGreffier au Gouvernement du Honduras,quia étéinformé que lePrési-
dent delaCour avaitfixéau 25mai 1992ladate d'expiration du délaidans
lequel le Honduras pouvait déclarers'ils'opposait au désistement;

Considérantque, par une lettre datéedu 14mai 1992,communiquéeau
Greffier par télécopile 18mai 1992,lecoagent du Honduras a informéla
Cour que songouvernement ne s'opposait pas au désistement,

Prendactedu désistementde la Républiquedu Nicaragua de l'instance
introduite par la requête enregistrée28juillet 1986;
Ordonneque l'affaire soitrayéedu rôle.

Fait en anglais et en français, le texte anglais faisant foi, au Palais de
la Paix,à La Haye, le vingt-sept mai mil neuf cent quatre-vingt-douze,
en trois exemplaires, dont l'un restera déposé auxarchives de la Cour
et les autres seront transmis respectivement au Gouvernement de la
République du Nicaragua et au Gouvernement de la République du
Honduras.
