having regard to Articles 36 and qS of the Statute of t;e Court
Makes th4 jollowing Order
Whereas on March 3rd, 1954, the Ambassador of the Lnited
States of America to the Xetherlands filed in the Registry an
Application datedebruary 16th, 1954, and signed by the Agent
of theGo\.ernment of the Vnitcd States of America instituting
proceedings bcfore the Court against the Governmentof the
Hungarian People's Republic, "on account of certain actions of
the latterovcrnment in conccrt nith the Go~wnment of the
Union of SovietSocialist Republic;"100 AIRCRAFT AND CREW OF U.S.A. (ORDER OF 12 VII 54)
IVhereas on the same day the Ambassador of the United States
of America to the Netherlands filed in the Registry another
Application dated February 16th, 1954, and signed by the Agent
of the Government of the Vnited States of America instituting
proceedings before the Couh against the Government of the
Union of Soviet Socialist Republics in respect of the same cluestion,
and the Government of the United States of America expressed
a wish that the two Applications should be considered and dealt
with together ;
Whereas the Application instituting proceedings against the
Hungarian People's Republic was duly communicated by the
Registry on March 3rd, 1954. to the Minister for Foreign Affairs
of the Hungarian People's Republic ;
Whereas both Applications were duly cornmunicated by the
Registry to al1 the Members of the Vilited Nations, through the
Secretary-General of the United Nations, and to al1 other States
entitled to appear before the Court ;
Whereas the Application instituting proceedings against the
Hungarian People's Republic was directly communicated by the
Registry on March 3rd, 1954, to the Ambassador of the Cnion
of Soviet Socialist Republics to the Netherlands and the Appli-
cation of the United States of America instituting proceedings
against the Union of Soviet Socialist Republics was communicated
on the same day to the Minister for Foreign Affairs of the Hun-
garian People's Republic ;
Whereas the Application instituting proceedings against the
Hungarian People's Kepublic contains the following paragraph :
"The LTnitedStates Government, in filing this application with
the Court, submits to the-Court's jurisdiction for the purposes of
this case. The Hungarian Government appears not to have filedany
declaration with the Court thus far, and although it was invited to
do so by the United States Government in the Note annexed hereto
it has not made any responsive reply to the invitation. The Hunga-
rian Government is, however, qualified to submit to the jurisdiction
of the Court in this matter and may uponnotificationof this applica-
tion by the Registrar, in accordance with the Rules of the Court,
take the necessary steps to enable the Court's jurisdiction overboth
parties to the dispute to be confirmed.
Thus the United States Government founds the jurisdiction of
this Court on the foregoingconsiderations and on Article 36 (1)of
tlie Statute."
Whereas in a letter dated June qth, 1954, from the Chargé
d'affaires of the Hungarian People's Republic in the Netherlands
to the Registry it was stated that :
"...the Government of the Hungarian People's Republicis unable
to submit in this case to the jurisdiction of the International Court

Whereas a copy of the above-mentioned letter was commu-
nicated to the Agent of the Government of the United States
of America by a letter dated June 16th, 1954;
Whereas, in these circumstances, the Court finds that it has
not before it anv acceptance by the Government of the Hungarian
People's Republic of the jurisdiction of the Court to deal with
the dispute which is the subject of the Application submitted
to it bp the Government of the United States of America and
that therefore itcan take no further steps upon this Application ;
orders that the case shall be removed from the list.
Done in English and French, the English text being authori-
tativc, at the Peace Palace, The Hague, this twelfth day of July,
one thousand nine hundred and fifty-four, in three copies, one
of which will be placed in the archives of the Court and the others
transmitted to the Government of the United States of America
and to the Government of the Hungarian People's Republic,
respectively.

ainsi composée,
après délibéré en chambre du conseil,
vu les articles 36 et 48 du Statut de la Cour;
rend l'ordonnance suivante:
Considérant que le 3 mars 1954, l'ambassadeur des États-unis
d'Amérique aux Pays-Ras a déposéau Greffe une requête datée
du 16 février 1954, signée par l'agent du Gouvernement des
Etats-Unis d'Amérique, introduisant devant la Cour une instance
contre le Gouvernement de la République populaire de Hongrie
au sujet((de certains actes accomplis par ce dernier Gouvernement
de concert avec le Gouvernement de l'Union des Républiques
socialistes soviétiques;

IVhereas on the same day the Ambassador of the United States
of America to the Netherlands filed in the Registry another

d'Amérique aux Pays-Bas a déposéau Greffe une autre requête,
datée du 16 février 1951. signée par l'agent du Gouvernement
des États-unis d'Amérique, introduisant devant la Cour une
instance contre le Gouvernement de l'Union des Républiques
socia!istes soviétiques pour la même question, le Gouvernement
des Etats-Unis exprimant le désir que les deux requêtes soient
examinées en même temps ;
Considérant que la requête introduisant l'instance contre la
République poplaire de Hongrie a été dûment communiquée
par le Greffe au ministre des Affaires étrangères de Hongrie, le
3 Considerant que les deux requêtesont étédûment communiquées
par le Greffe à tous les hlembres des Nations Unies, par l'entremise
du Secrétaire généraldes Nations Unies, ainsi qu'aux autres États
admis à ester en justice devant la Cour;
Considérant que la requête introduisant l'instance contre la
République populaire de Hongrie a étédirectement communiquée
le 3 mars 1954 par le Greffe à l'ambassadeur de l'vnion des Répu-
bliques socialistes soviétiques aux Pays-Bas et que communication
de la requête des États-unis d'Amérique introduisant l'instance
contre l'Union des Républiques socialistes soviétiques a été faite
à la mêmedate au ministre des Affaires étrangères de Hongrie ;
Considérant que la requête introduisant l'instance contre la
République populaire de Hongrie contient le paragraphe suivant :
«Le Gouvernement des États-Unis, en présentant à la Cour la
présenterequête,déclareaccepter la juridiction de la Cour dans la
présente affaire. Il ne semble pas qu'à ce jour, le Gouvernement
hongrois ait remis une déclaration à la Cour, et bien qu'il ait été
invitéà le faire par le Gouvernement des Etats-Unis dans la note
jointe en annexe, il n'a fait aucune réponseutilà cette invitation.
Le Gouvernement hongrois est cependant qualifiépour reconnaître
la juridiction de la Cour en la matière et il lui est loisible, lorsque
cette requêtelui sera notifiéepar leGreffier,conformémentauRègle-
ment de la Cour, de prendre les mesures nécessaires pourque soit
confirméela juridiction de la Cour à l'égarddes deux parties au
différend.
Ainsi, le Gouvernement des États-Unis fonde la juridiction de la
Cour sur les considérations quiprbcèdent et sur l'article 36, para-
graphe 1, du Statut.))
Considérant que, dans une lettre adressée au Greffe le 14 juin
1954 par le chargéd'affaires de la République populaire de Hongrie
aux Pays-Bas il est dit :
« ...le Gouvernement de la République populaire Iiongroise n'est
pas à mémede se soumettre en ce cas riIn compi.tcncc de In Cour
internationale de Justice » ;

l'agent du Gouvernement des Etats-Unis d'Amérique, par lettre
du 16 juin 1954;
Considérant que, dans ces conditions, la Cour doit constater
qu'elle ne se trouve en présence d'aucune acceptation par le
Gouvernement de la République populaire de Hongrie de la
juridiction de la Cour pour connaître du différend faisant l'objet
de la requête dont elle a étésaisie par le Gouvernement des États-
Unis d'Amérique, et qu'en conséquence, elle ne peut donner siiite
à cette requête ;
ordonne que l'affaire soit rayée du rôle.
Fait en anglais et en français, le texte anglais faisant foi, au
Palais de la Paix, à La Haye, le douze juillet mil neuf cent
cinquante-quatre, en trois exemplaires, dont l'un restera déposé
aux archives de la Cour et dont les,autres seront transmis respec-
tivement au Gouvernement des Etats-Unis d'Amérique et au
Gouvernement de la République popiilaire de Hongrie.
