(ITALY v. FRANCE, UNITED KINGDOM OF GREAT
BRITAIN AND NORTHERN IRELAND AND

UNITED STATES OF AMERICA)

The InternationaCourt of Justice,

having regard to Articles8 and 49 of the Statute of the Court,

having regard to Article 37 of the Rules of C;urt

Makes the followinOrder.
Having regard to the Application dated May ~gth, 1953, and
filedin the Registry of the Court on that date, by which the Italian
Republic instituted proceedings against France, the United King-
dom of Great Britain and Northern Ireland and the United States
of America in the case of the monetary gold removed from Rome

in 1943,
Having regard to the Order of July ~st, 1953, fixing time-limits
for the filing of a Memorial and Counter-Memorials in that case, and
reserving the rest of the procedure for further decision,
Whereas on October 3oth, 1953, the Agent of the Government of
the Republic of Italy in this case filed in the Registry a document
bearing the same date, and entitled "Affaire de l'or monétaire pris
à Rome en 1947 - Question préliminaire",

Whereas the said document, filed before the expiry of the time-
limit fixed for the filing of a Memorial by the Government of the
4Italian Republic, requests the Court, for the reasons therein set
out, and having regard to Article 62 of the Rules, to adjudicate on
the preliminary question of its jurisdiction to deal with the merits
of the claim set forth under No. I of the Submissions of the Appli-
cation submitted to the Court on May ~gth, 1953,
Whereas, without prejudging the question of the interpretation
and application of Article 62 of the Rules of Court, itis deemed
appropriate to give the Government of the Italian Republic an
opportunity to define its position and to submit documents in

support thereof ;

Suspends the proceedings on the merits ;

Fixes December 15th, 1953, as the time-limit within which the
Italian Government may present a written statement defining its
position, together with documents in support ;

Fixes February 15th, 1954, as the time-limit within which the
Goverpments of the French Republic, the United Kingdom of
Great Britain and Northern Ireland and the United States of
America may present written statements of their observations and
submissions ;

Reserves the rest of the procedure for further decision.

Done in English and French, the English text being authoritative,
at the Peace Palace, The Hague, this third day of November, one
thousand nine hundred and fifty-three, in five copies, one of which
will be placed in the archives of the Court and the others will be
transmitted to the Govemments of the Italian Republic, of the
French Republic, of the United Kingdom of Great Britain and
Northern Ireland and of the United States of America, respectively.

La Cour internationale de Justice,

vu les articles8 et49 du Statut de la Cour,

vu l'article7 du Règlement de la Cour ;

Rend Z'ordonnancesuivante :
Vu larequêtedu 19mai 1953, enregistréele mêmejour au Greffe,
par laquelle la République italienne a introduit contre la France,
le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord et
les États-Unis d'Amérique, l'affaire deor monétaire pris à Rome

en 1943,

Vu l'ordonnance du lerjuillet1953, fixant les délais pour le
dépôt d'un mémoire et de contre-mémoires en cette affaire, et
réservant la suite de la procédure,
Considérant que, l30 octobre 1953,l'agent du Gouvernement de
la République italienne en la susdite affaire a remis au Greffe un
document, portant cette mêmedate et intitulé ((Affaire de l'or
monétaire prisà Rome en 1943 - Question préliminair»,

Considérant que ce document, déposéavant l'expiration du délai
pour la présentation du mémoire du Gouvernement italien, prie

Deputy-Registrar.la Cour, pour les considérations qui y sont exposées,et vu l'article 62
du Règlement, de statuer sur la question préliminaire de sa com-
pétence pour connaître au fond de la demande formulée au no I
des conclusions de la requêteprésentée à la Cour le 19 mai 1953,

Considérant que, sans préjuger la question de l'interprétation et
de l'application de l'article du Règlement de la Cour, il convient
de donner au Gouvernement de la République italienne l'occasion
de préciser sa position et de présenter les documents sur lesquels il
entend la fonder ;

Suspend la procédure au fond ;

Fixe au 15 décembre 1953 l'expiration du délai pendant lequel
le Gouvernement italien pourra présenter un exposéécrit précisant
sa position, ainsi que tous documents à l'appui de celle-c;
Fixe au 15 février 1954 l'expiration du délaipendant lequel les
Gouvernements de la République française, du, Royaume-Uni de
Grande-Bretagne et d'Irlande du Nord et des Etats-Unis d'Amé-
rique pourront présenter les exposés écrits de leurs observations
et conclusions ;

Réservela suite de la procédure.

Fait en anglais et en français, le texte anglais faisant foi, au
Palais de la Paix, à La Haye, le trois novembre mil neuf cent
cinquante-trois, en cinq exemplaires, dont l'un restera déposéaux
archives de la Cour et dont les autres seront transmis respectivement
aux Gouvernements de la République italienne, de la République

française, du Royaume-Uni de Grande-Bretagne et d'Irlande du
Nord et des États-unis d'Amérique.
