ANGLO-NORWEGIAN

FISHERIES CASE

The International Court of Justice,

having regard to Article 48 of the Statute of the Court,
having regard to Articles 37 and 38 of the Rules of Court,

having regard to the Order made by the Acting President of the
Court on November gth, 1949, to determine the procedure in the
Anglo-Nonvegian Fisheries case,

Makes thejollowingOvder :

Whereas by letter dated March 7th, 1950, the Agent of the Nor-
wegian Government has aslred that the time-lirnit for the presenta-
tion of the Nonvegian Goverilment's Counter-Mernorial, which had
been fixed by the Order of November gth, 1949, for May 31st, 1950.
be extended to July 31st, 1950;

Whereas, by letter of Iilarch aoth, 1950, the Agent of the United
Kingdom of Great Britain and Northern Ireland declared that he
did not object to this request provided that, if the Court saw fit to
grant it, this should bedone only subject to the condition that, if
judgment was not given bëfore the opening of the third fishing
season, the Decree of 1935 should not be applied beyond the Red or
Yellow Lines ;
Whereas the condition attached by the ,\gent of the United King-
dom Government to his assent to this request could be satisfied only
by resorting to the procedure appropriatethereto ; Whereas the Agent of the United Kingdom Government has for-
mally reserved his right to ask, if necessary, for an extension of the
time-limit for the presentation of the Reply of his Govemment ;

Decides

to postpone to the following dates the lime-limits fixed by the
Order of the Acting President of the Court of November gth, 1949 :

for the Norwegian Counter-Memorial, to July 31st, 1950 ;

for the Reply of the Govemment of the United Kingdom of Great
Britain and Northern Ireland, to October yst, 1950 ;
for the Rejoinder of the Norwegian Government, to Decem-
ber 31st, 1950.

Done in French and English, the French text being authoritative,

at the Peace Palace, The Hague, this twenty-ninth day of March,
one thousand nine hundred and fifty, in three copies, one of which
willbe placed in the archives of the Court and the others transmitted
to the Government of the United Kingdom and to the Norwegian
Govemment respectively.

La Cour internationale de Justice,

vu l'article 48 du Statut de la Cour,
vu les articles 37 et 38 du Règlement de la Cour,

vu l'ordonnance rendue le g novembre 1949 par le Président en
exercice de la Cour pour fixer la procédure dans l'affaireglo-
norvégienne des pêcheries,

Rend l'ordonnance suivant:

Considérant que, par lettre en date d7 mars 1950, l'agent du
Gouvernement norvégiena sollicitéla prorogation au 31 juillet0
du délaipour la présentation du Contre-Mémoiredu Gouvernement
norvégien, fixéau 31 mai 1950 par l'ordonnance du g novembre
1949 ;

Considérant que, par lettre en date 20 mars 1950, l'agent du
Gouvernement du Royaume-Uni de Grande-Bretagne et d'Irlande
du Nord a déclaré qü'il ne s'opposait pas à cette demande, pourvu
que, si la Cour estimait convenable d'y faire droit, elle ne le fasse
que sous la condition que si le jugement n'était pas rendu avant
le début de la troisième saison de pêche, ledécret de5 ne serait
pas appliqué au large des lignes rouge ou jaune
Considérant que la condition, mise par l'agent du Royaume-Uni
à son acquiescement, ne pourrait recevoir satisfaction que par le
recours à la procédure appropriée;

rendue le g novembre 1949par le Président en exercice de la Cou:
pour le Contre-Mémoiredu Gouvernement du Royaume de Nor-
vège,au 31 juillet 195;

pour la Répliquedu Gouvernement du Royaume-Uni de Grande-
Bretagne et d'Irlande du Nord, au 31 octobre 1950 ;
pour la Duplique du Gouvernement du Royaume de Norvège, au
31 décembre 1950.

Fait en français et en anglais, le texte français faisant foi, au

Palais de la Paix, à La Haye, le vingt-neuf mars mil neuf cent
cinquante, en trois exemplaires, dont l'un restera déposéaux
archives de la Cour et les autres seront transmis respectivement
au Gouvernement du Royaume-Uni et au Gouvernement du
Royaume de Korvège.
